CBP (Customs and Border Protection) - Definition

U.S. Customs and Border Protection (CBP) is the customs and border protection agency of the United States. Among other things, it is responsible for inspecting goods upon import and, in cases of doubt, determining the definitive country of origin of a product.

Central to this is the principle of ‘substantial transformation. The CBP decides on a case-by-case basis whether a manufacturing or processing step has transformed a product into a new good with its own character, purpose or name. Only then can the country of origin change from that of the original product.

This assessment is particularly relevant for complex products such as network hardware, electronics or modular IT systems. In practice, a very detailed examination is carried out to determine which production steps actually took place in the respective country. Mere final assembly, configuration or the installation of software or firmware is often insufficient to establish a new origin.

The CBP publishes its decisions in the form of so-called ruling letters, which are considered binding case-by-case interpretations. Companies use these decisions as guidance to better assess their own supply chain and avoid risks when importing.
